Contract
It is necessary to make a contract for every job which requires detective services with the specification of the type of services and costs, as well as a power of attorney.
Power of attorney
Upon concluding a contract, the client shall consign a signed special power of attorney to the investigator. The content of the special power of attorney shall refer to the evidence and data that are to be collected, i.e. to the reason for collecting and processing the data and evidence which are the subject of the contract.
Authorities of a private investigator (PI)
The authorities of a private investigator are based on the Private Investigation Law (Official Gazette No. 24/2009) and on the guidelines for evidence collection, the content and the way of conducting data collection (Official Gazette No. 121/2011).
What a PI can and is allowed to do for You?
A PI can collect information on:
- missing people or people hiding form the party, people who wrote or sent annonimous letters, people who spread slander, insults or suspicion
- people who caused damage to the party
- lost or stolen objects
- evidence that party needs for insurance, for gaining rights or privileges gained before the court or before other state administration bodies, as well as before societies and associations
- person's efficiency in work performance
- success and/or professionalism of trade companies and other legal entities
- facts and circumstances related to a personal position of the citizens and their property status
- candidates for employment and employees, but only with their written consent, which, according to a special regulation, the employer is authorized to collect
- private prosecutions for criminal offences and perpetrators of criminal offences
- breaches of duties or the violation of labour discipline
Apart from collecting information, a PI can:
- plan and implement measures for protecting trade secrets, IT systems, economic and personal data and information in accordance with the terms of the contract signed with the parties
- perform the delivery of writs in judicial, administrative and other proceedings
The above listed things a PI shall do by:
- collecting data from physical and legal entities
- collecting data from state administrative bodies and other legal entities which, by virtue of public authorities, keep certain registers and records (registration of permanent and temporary residence, insurance policies, tax returns, owners of motor vehicles and vessels, data from civil registry books, data about pension and disability insurance)
- collecting the data and evidence abroad
- processing the data
- securing evidence and objects by means of criminology and technology
- excluding clues and objects by means of criminology and technology
- offering and giving rewards for information and evidence
- publishing the photos of persons and objects reported as missing in mass media
